Terms of service

Effective October 29, 2026

These terms are an agreement between you and Daigle Marketing LLC ("Daigle Marketing", "we", "us"). They apply when you use daiglemarketing.com, sign in to our client dashboard, or buy a website or hosting from us. By paying for a service or signing in, you agree to them. If we sign a separate written agreement with you, that agreement wins wherever the two differ.

1. What we do

We design, build and host websites for local businesses. You pay a one-time website fee and a monthly hosting and care fee. How billing, renewals and cancelling work is set out in our billing and cancellation terms, which are part of these terms.

2. Free previews

We sometimes build a free preview of a website for a business before talking to it, using details the business has published in public listings. Previews are clearly labeled as unofficial, are kept out of search engines, and are taken down after 45 days or as soon as the business asks. A preview creates no obligation for anyone.

3. Your part

  • Give us accurate information about your business, and tell us when something changes or is wrong.
  • Only give us text, photos, logos and other material you own or have permission to use.
  • If your trade needs a license, give us your valid license number to show on the site.
  • Review your site before it launches. You can change its wording at any time.
  • Keep the email account you sign in with secure, and only add people you trust to your team. You're responsible for what your team does in the dashboard.
  • Use the messages your contact form collects lawfully, and only to answer the people who sent them.

4. Acceptable use

Your site and dashboard may not be used for anything illegal, deceptive or infringing; for hateful, violent or adult material; for fake reviews or testimonials (customer quotes need the customer's permission); or to send spam, spread malware or attack our systems or anyone else's. If something breaks this rule, we may remove it or suspend the service, and we'll tell you why whenever we can.

5. Who owns what

You own your business name, logo, photos and the text you give us, and your domain if it's registered in your name. We own our designs, templates, code, dashboard and tools. While your hosting is active, you may use your site's design for your business, and you let us store, copy and display your material to run your site. We may show your site as an example of our work unless you ask us not to. When you leave, we'll send you a copy of your site's text and photos if you ask within 30 days, and help you move a domain we registered for you to your own account.

6. AI-assisted writing

We use AI tools to help draft website text and emails, using public business details only (see our privacy policy). A person reviews what goes out, and you can review and change anything on your site. If you spot something inaccurate, tell us and we'll fix it.

7. Payments

Prices are in US dollars and are shown before you pay. Payments are processed by Stripe under its own terms. You're responsible for any taxes that apply to your purchase.

8. Keeping things running

We work to keep sites fast, secure and online, but no service can promise to be available every minute. We may need short maintenance windows, and outages at the companies we rely on (such as Cloudflare, Stripe or Google) are outside our control. We may improve or change dashboard features over time.

9. No guaranteed results

A good website helps customers find and contact you, but we don't guarantee search rankings, traffic, leads or sales. Apart from what these terms promise, the services are provided "as is" to the extent the law allows.

10. Limits on liability

To the extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential damages or lost profits, and our total liability for any claim about the services is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

11. Your material

If someone makes a claim against us because of material you gave us (for example, a photo you didn't have the rights to) or because of how you used the services against these terms, you'll cover the reasonable costs of that claim.

12. Ending the service

You can cancel any time, as described in our billing and cancellation terms. We may suspend or end the service if a payment stays unpaid for 30 days, or if these terms are seriously broken, and we'll give you notice whenever we can.

13. Disputes

If something goes wrong, please talk to us first; most problems are quickly fixed. These terms are governed by the laws of the State of Florida, and any dispute that can't be settled will be handled by the courts in Hillsborough County, Florida.

14. Changes to these terms

If we change these terms, we'll post the new version here with a new effective date. Clients get an email at least 30 days before an important change takes effect, and can cancel before then.
